Klass u.a. ./. Deutschland
Auszug aus EGMR, 24.02.1995 - 16424/90
We find it inconsistent and contrary to the logic of the Convention system that the constraints of a legal status which are judged, in terms of possible discrimination under Article 14 (art. 14), to have an objective and reasonable justification should not be similarly justified in relation to enjoyment of the right to respect for family life under Article 8 (art. 8) (see, mutatis mutandis, the Klass and Others v. Germany judgment of 6 September 1978, Series A no. 28, p. 31, para. 68). - EGMR, 09.06.1988 - 9749/82
W. c. ROYAUME-UNI (ARTICLE 50)
Auszug aus EGMR, 24.02.1995 - 16424/90
Beyond that, the Court is not empowered under the Convention to make the orders and declarations sought (see, inter alia, the W. v. the United Kingdom judgment of 9 June 1988, Series A no. 136-C, p. 26, para. - EGMR, 13.06.1979 - 6833/74
MARCKX v. BELGIUM
Auszug aus EGMR, 24.02.1995 - 16424/90
According to the Court's well established case-law, a difference of treatment is discriminatory if it has no reasonable and objective justification, that is, if it does not pursue a legitimate aim or if there is not a reasonable relationship of proportionality between the means employed and the aim sought to be realised (see, amongst numerous authorities, the Marckx v. Belgium judgment of 13 June 1979, Series A no. 31, p. 16, para. 33).

GOLDER c. ROYAUME-UNI
Auszug aus EGMR, 24.02.1995 - 16424/90
1 (art. 6-1) affords a procedural safeguard, namely the "right to a court" in the determination of one's "civil rights and obligations" (see the Golder v. the United Kingdom judgment of 21 February 1975, Series A no. 18, p. 18, para. 36); whereas not only does the procedural requirement inherent in Article 8 (art. 8) cover administrative procedures as well as judicial proceedings, but it is ancillary to the wider purpose of ensuring proper respect for, inter alia, family life (see, for example, the B. v. the United Kingdom judgment of 8 July 1987, Series A no. 121-B, pp. 72-74 and 75, paras. 63-65 and 68). - EGMR, 26.05.1994 - 16969/90
KEEGAN v. IRELAND
Auszug aus EGMR, 24.02.1995 - 16424/90
In this respect the present case is to be distinguished from the case of Keegan v. Ireland (judgment of 26 May 1994, Series A no. 290). - EGMR, 21.02.1990 - 9310/81
POWELL ET RAYNER c. ROYAUME-UNI
Auszug aus EGMR, 24.02.1995 - 16424/90
The compass of the case before the Court is delimited by the Commission's decision on admissibility (see, inter alia, the Powell and Rayner v. the United Kingdom judgment of 21 February 1990, Series A no. 172, p. 13, para. 29). - EGMR, 23.06.1993 - 12952/87
RUIZ-MATEOS c. ESPAGNE
Auszug aus EGMR, 24.02.1995 - 16424/90
Nevertheless, notwithstanding the special characteristics of the adjudication to be made, as a matter of general principle the right to a fair - adversarial - trial "means the opportunity to have knowledge of and comment on the observations filed or evidence adduced by the other party" (see the Ruiz-Mateos v. Spain judgment of 23 June 1993, Series A no. 262, p. 25, para. 63). - EGMR, 10.02.1983 - 7299/75
ALBERT ET LE COMPTE c. BELGIQUE
Auszug aus EGMR, 24.02.1995 - 16424/90
1 (art. 6-1) (see the Albert and Le Compte v. Belgium judgment of 10 February 1983, Series A no. 58, p. 16, para. 29). - EGMR, 05.11.1981 - 7215/75
X v. THE UNITED KINGDOM
Auszug aus EGMR, 24.02.1995 - 16424/90
The Court accepts that in this sensitive domain of family law there may be good reasons for opting for an adjudicatory body that does not have the composition or procedures of a court of law of the classic kind (see, mutatis mutandis, the X v. the United Kingdom judgment of 5 November 1981, Series A no. 46, p. 23, para. 53). - EGMR, 09.06.1988 - 9276/81
O. v. THE UNITED KINGDOM (ARTICLE 50)
Auszug aus EGMR, 24.02.1995 - 16424/90
She could not, so they argued, be said to have suffered a loss of real opportunities; nor was the present case comparable to other cases concerned with children in which damages had been awarded for feelings of frustration and helplessness (such as O. v. the United Kingdom, judgment of 9 June 1988, Series A no. 136-A, or Keegan v. Ireland, loc.

Februar 1995, Serie A Band 307-B, S. 57, Nr. 91, Hoppe ./. Deutschland, Individualbeschwerde Nr. 28422/95 , Nr. 61, 5. Dezember 2002, Buchberger ./. Fall K. gegen DEUTSCHLAND
Urteil vom 19. Februar 1998 in der Sache Guerra u.a. . /. /. Vereinigtes Königreich, Serie A, Band 307-B, S. 55, Nr. 87, und Urteil in der Sache Ignaccolo-Zenide . /. Rumänien , 31679/96, Nr. 99, CEDH 2000-I). - EGMR, 08.04.2004 - 11057/02
Entziehung der elterlichen Sorge
Aus gegebenem Anlass (siehe Rechtssachen Sahin ./. Deutschland [GC], Nr. 30643/96, Nr. 43, vom 8. Schweden (Nr. 1) vom 24. März 1988, Serie A, Nr. 130, S. 28-29, Nr. 56, Urteil McMichael ./. Vereinigtes Königreich vom 24. Februar 1995, Serie A Nr. 307-B, S. 51 Nr. 73).
- EGMR, 12.06.2003 - 35968/97
Rechtssache V. K. gegen DEUTSCHLAND
Februar 1995, Serie A, Band 307-B, S. 57, Nr. 91, Buchberger ./. Österreich , Beschwerde-Nr. 32899/96, Nr. 49, 20. Dezember 2001, und P., C. und S. ./. Vereinigtes Königreich , Beschwerde-Nr. 56547/00, Nr. 120, 16. Juli 2002). - EGMR, 21.12.2001 - 31465/96
SEN c. PAYS-BAS
Royaume-Uni du 24 février 1995, série A no 307, p. 55, § 86). - EGMR, 19.10.2005 - 32555/96
ROCHE c. ROYAUME-UNI
In the first place, he maintained that the procedures and systems surrounding the tests did not fulfil the procedural requirements inherent in respect for private life, so that the Government had failed adequately to secure and respect his Article 8 interests (see W. v. the United Kingdom, judgment of 8 July 1987, Series A no. 121, and McMichael v. the United Kingdom, judgment of 24 February 1995, Series A no. 307-B). - EGMR, 16.07.2002 - 56547/00
P., C. ET S. c. ROYAUME-UNI
Royaume-Uni, arrêt du 24 février 1995, série A no 307-B, p. 57, § 91).
Royaume-Uni, arrêt du 24 février 1995, série A no 307-B).
- EGMR, 19.02.1996 - 23218/94
GÜL v. SWITZERLAND
"According to the Court's well established case-law, "the mutual enjoyment by parent and child of each other's company constitutes a fundamental element of family life"", as the Court pointed out in paragraph 86 of the McMichael v. the United Kingdom judgment of 24 February 1995, Series A no. 307-B, p. 55. Consequently, decisions of State authorities hindering such enjoyment in principle amount to an infringement of the State's obligation to respect the family life of those concerned. - EGMR, 25.04.1996 - 15573/89
GUSTAFSSON v. SWEDEN
The Court is not prevented from taking them into account in determining the merits of the applicant's complaints under the Convention if it considers them relevant (see the Barthold v. Germany judgment of 25 March 1985, Series A no. 90, p. 20, paras. 41-42; and the McMichael v. the United Kingdom judgment of 24 February 1995, Series A no. 307-B, p. 51, para. 73).Consequently, additional facts supplementing or clarifying the facts established by the Commission are admissible (see the McMichael v. the United Kingdom judgment of 24 February 1995, Series A no. 307-B, p. 51, para. 73), but new facts which are contradictory to those established by the Commission, as a rule, are not.
- EGMR, 10.07.2014 - 2260/10
TANDA-MUZINGA c. FRANCE
Pays-Bas, no 29192/95, § 66, CEDH 2000-VIII ; Saleck Bardi c.
